Terms of Use & Treatment Terms
Last updated: September 2026
These terms cover the website ilyamarchuk.com and the two services offered through it: at-home therapeutic massage and guided ice-bath / cold exposure sessions. They are written to be clear about what you receive, what it costs, how to cancel and what protects you as a client.
1. Who we are
The Site ilyamarchuk.com (the “Site”) is operated by Ilya Marchuk (“we”, “the practitioner”). Contact: hello@ilyamarchuk.com. Using the Site or booking a session means you accept these terms. If you are under 18, a parent or legal guardian must approve the booking and be present.
2. The massage service — exactly what is included
The at-home massage is a professional therapeutic and relaxation massage given at your address inside the Be’er Sheva service area, in the length shown on the page you booked from (typically 30 or 45 minutes of hands-on treatment). The practitioner brings the massage table, clean linens and oils; you provide roughly 2×2 metres of clear floor space, and access to a sink. The session is strictly non-sexual and non-medical. Draping is used at all times and only the area being worked on is uncovered. Any sexual request ends the session immediately with full payment due and no future bookings.
3. Promotional / practice pricing
Some massage sessions are offered at a heavily reduced promotional price because they are part of the practitioner’s ongoing practice and professional training hours. The treatment itself, the hygiene standard and your rights are identical to a full-price session. Promotional prices are personal, non-transferable, limited in number and valid only for the period stated on the relevant page. The exact price of your session is the one shown to you at booking and confirmed by phone — no additional or hidden charges are added afterwards. Travel inside the stated service area is included.
4. Ice bath and cold exposure sessions
Cold water immersion and breathwork carry real physiological risk (cold shock, hyperventilation, fainting, arrhythmia). Sessions are always guided; never enter the water alone, never immediately after alcohol or cannabis, and never hold your breath in or under water. You must follow the guide’s instructions on entry, breathing, duration and exit, and leave the water immediately if you feel dizzy, numb beyond the expected cold, chest pain or panic. Immersion time is capped by the guide.
5. When you must not participate — medical conditions
Do not book, and tell us before the session, if any of the following apply. In these cases participation requires written approval from your physician, and we may decline the booking:
- Heart disease, arrhythmia, uncontrolled high or low blood pressure, or a past heart attack or stroke (cold exposure)
- Pregnancy, epilepsy, Raynaud’s phenomenon, cold urticaria or severe asthma
- Deep vein thrombosis, blood-clotting disorders, or blood-thinning medication
- Fever, active infection, contagious skin condition, open wounds or recent surgery
- Cancer treatment, severe osteoporosis, or a recent fracture, sprain or whiplash
- Being under the influence of alcohol, cannabis or sedative medication
6. Health declaration and your responsibility
Before the first session you will be asked a short set of health questions, verbally or in writing. Answering honestly is a condition of the service. We are not doctors: nothing offered here is medical advice, diagnosis, physiotherapy or treatment of an illness, and it does not replace medical care. You participate at your own responsibility. You may ask to change pressure, stop or end any session at any moment, for any reason, with no explanation and no penalty.
7. Booking, confirmation and arrival
You book a date and time in the Site calendar and leave a name and phone number. The booking becomes final only once we confirm it with you, usually by a short phone call in which we verify the address and any health notes. Please be ready at the agreed time. If you are late, the session ends at the original end time. If the practitioner is late, the missing minutes are added or the session is rescheduled at no cost.
8. Cancellation, rescheduling and refunds
You may cancel or reschedule free of charge up to 24 hours before the session. A cancellation less than 24 hours before, or a no-show, may be charged up to the full session price. In addition, and beyond any policy of ours, Israeli consumer protection law lets you cancel a transaction within 14 days of making it, provided the cancellation reaches us at least 2 business days before the appointment; in that case you receive a refund and we may deduct only the cancellation fee permitted by law (5% of the transaction or ILS 100, whichever is lower). We may cancel or shorten a session for safety reasons, illness, or unsafe conditions at the address — in that case you are not charged, and a paid session is refunded in full or rescheduled, as you prefer.
9. Payment
Unless stated otherwise on the booking page, payment is made at the end of the session by the methods listed there. Prices include VAT where applicable. A receipt is issued for every payment. Gift or package purchases are valid for the period stated at purchase.
10. Your privacy
Your contact details, address and health answers are used only to deliver and manage your sessions, and are handled as described in our Privacy Policy. Health information is sensitive information and is never shared for marketing.
11. Content and intellectual property
All content on the Site — text, photographs, video, logo and design — belongs to the practitioner and may not be copied, republished or used commercially without prior written consent. Photos of clients are published only with explicit consent, which can be withdrawn at any time.
12. Liability
We carry out sessions with professional care. To the extent permitted by law, our liability is limited to the amount paid for the session in question, and we are not liable for indirect or consequential damage, or for damage caused by information you withheld in the health declaration. Nothing here limits liability that cannot be limited by law, including for bodily injury caused by negligence.
13. Law, complaints and contact
These terms are governed by Israeli law, with exclusive jurisdiction in the competent courts of Be’er Sheva. If something in your session was not right, write to hello@ilyamarchuk.com — complaints are answered personally within a few business days. We may update these terms; the version published on this page is the one in force.
